Seal Court Record
If your attorney didn't win your drunk driving case, you’ll have your criminal record sealed or expunged it needs court approval. Only those aspects of the file that the judge has ordered sealed. During a partial sealing, certain information in the court record will continue to be available for public investigation.
Materials ordered sealed by the court are disclosable once the sealing order runs out. News media or members of the public should be aware of the date when the sealing order will run out. Please keep in mind, often, the defense case information may not be disclosable at any point in the future in the court record after being sealed.
Anyone affected by court orders to seal or limit disclosure of materials on file in line with a court proceeding may petition the appellate court for review of that order within 72 hours of its issuance, EXCEPT that the following key points will not be looked at again:
- orders that fall under family matters or search warrant statutes;
- any legal provision which allow the court to seal or limit disclosure of materials in the record at a pretrial or trial stage; or,
- a court rule that seals or limits disclosure of affidavits for arrest warrants (DUI).
